There are two major penalties under the False Claims Act:

  • Civil Liability: For anyone who knowingly submits or causes a false claim or fraudulent claim to the federal government, there are certain damages that they have to provide. The amount is specified and is asked for every false claim made.
  • Criminal Liability: Any healthcare provider presenting false claims knowingly to the government organizations or institutions to get reimbursement is liable to criminal liability. Punishment up to 5 years of imprisonment and up to $500,000 in damages can be charged.

Oil & Gas Executive

A company executive had to take several days of medical leave after his son suddenly fell ill. However, while on leave, his company suddenly fired him, claiming his work had recently been sub-par. The company’s excuse that they had not illegally infringed on his protected medical leave did not hold water, and it chose to instead offer a settlement not long after the case was filed.

A store clerk needed several weeks of medical leave after she suffered complications following a routine surgery.
